Defense mulls mistrial in Tornado Cash saga: Evidence dispute rocks Roman Storm's case

Storm's Defense Gears Up for Mistrial Showdown Over Shady Romance Scam Link

Tornado Cash Co-Founder's Legal Team Questions Validity of Key Witness Testimony

Hold onto your hats, crypto fans! Roman Storm's defense is ready to rumble, planning to go for a mistrial after a government witness, tangled up in a romance scam, couldn't prove a direct link to Tornado Cash. The drama's unfolding fast!

Storm's lawyers brought the heat to U.S. District Judge Katherine Polk Failla on Monday, shaking things up in court. This all went down right after government witness Hanfeng Lin spilled the beans about losing nearly a quarter mil in a crypto scam. She claimed some of her swiped cash took a detour through Tornado Cash.

But wait, Storm's lawyer, David Patton, wasn't having it. He shot back, saying their deep dive didn't show any connection between Lin's money and the mixing protocol. Patton hinted they're huddling with Storm to weigh a mistrial move.

What's a mistrial, you ask? It's when a trial goes belly up due to some screw-up or shady evidence play. If the judge says yes, the case could get tossed or they'd start fresh with a new judge and jury.

Storm's crew's now grilling whether Lin's story should've even made it into court, pointing out the missing on-chain proof linking her cash to the protocol.

Lin shared her tale of woe, falling for a pig butchering scam back in '21. She then turned to a crypto recovery outfit called Payback, who handed her a report saying some of her dough had zipped through Tornado Cash.

But hold up, the defense wasn't buying it. They slammed Payback's report as iffy, and FBI agent Joseph DeCapua, who was supposed to trace Lin's cash and tie it to Tornado Cash, admitted on the stand that he never even looked at it.

Meanwhile, prosecutors are cooking up their next move, planning to bring in IRS analyst Stephan George to prove Lin's funds really did hit Tornado Cash. "We've got an ace up our sleeve with IRS Agent George, who'll show those few short hops to Tornado Cash," assistant U.S. attorney Thane Rehn boasted.

But it's not just the lawyers throwing down. Independent blockchain sleuths are jumping into the fray too. Taylor Monahan from MetaMask dug in and found zip, zero evidence that Lin's money ever touched Tornado Cash.

Backing her up is the notorious blockchain detective ZachXBT. Both are calling out Payback's tracing report, saying it doesn't jive with what's out there on the blockchain.

"It's a damn shame these vultures pop up first when folks are looking for help on Google," ZachXBT vented.

Storm's in hot water, facing a triple threat of charges: conspiracy to launder money, messing with U.S. sanctions, and running an unlicensed money biz. The feds are saying Tornado Cash washed over a billion bucks, some of it linked to North Korea's Lazarus Group, and they're pinning Storm with letting bad actors use the service without any checks.

Storm's not backing down, pleading not guilty. His defense is standing firm that Tornado Cash is a decentralized, non-custodial setup, with smart contracts running the show once they're out there.

The case is stirring up a storm of its own, with critics worried it could shake up software dev and financial privacy big time.
